PAYMENT:

In order to confirm the necessary reservations, a deposit for the travel program will be required. A second deposit of maybe required depending on the services that have been customized. Final payment is due 90 days prior to destination arrival. These payments are non-refundable, if the client cancels. (*) The package prices that are custom will be presented with a detail letter with inclusions of services. Payments are valid for by check or bank wire, If you choose to pay with a charge card, up to a 3% supplement fee may be applied. All prices quoted are in U.S. dollars.

Services and the various package components are sold only as a “package.” No “breakdowns” are available.
Any change, whatsoever, in the services featured in the quoted itinerary will modify the price(s).
We reserve the right to impose a service fee for each and every change requested after the services have been confirmed.

WILDLIFE VACATIONS, INC. REQUIRES THAT THE PASSENGER(S) FILL OUT A DOCUMENTATION FORM WITH FULL NAME(S) AS SPELLED IN THE PASSPORT(S), AS WELL AS PHOTOCOPIES OF THE FIRST PAGE OF THE PASSPORT(S) FOR PASSENGERS UNDER THE AGE OF 12 AT THE TIME OF TRAVEL.

TRAVEL DOCUMENTS:

U.S. citizens need a valid passport for travel to Ecuador. Passport(s) should be valid for at least 6 months at time of travel. Citizens of other countries must check with the local Ecuadorian Consulate or Embassy for specific VISA requirements. We are not responsible for losses of any kind, due to problems with travel documents! It is the ultimate responsibility of the passenger(s) to have all the necessary travel documents in order.

HOTEL(S):

The package price includes accommodations at the hotel(s) specified in the day-by-day itinerary or similar, including taxes and service charge. The right is reserved to substitute hotels for similar ones, should circumstances necessitate.

TRANSFERS & SIGHTSEEING:

Includes the services of English speaking guides. Some areas of travel may be at high altitudes. Caution is advised to passengers with a history of medical problems.

TRAVEL INSURANCE AND MEDICAL:

We strongly recommend that the passenger(s) or the client purchase travel and trip cancellation insurance to protect their travel investment. We are not responsible for any medical problems that may arise, for any reason, whatsoever.

DIVING POLICY:

Please bring all diving logs and any documentation showing proof of all open water dives. The Dive-master on the vessel will evaluate the passengers’ diving performance and at his discretion decide whether a passenger can dive at a specific dive site. Galapagos diving is for very experienced divers only, due to the strong currents, surges and cold waters. A minimum of 50 open water dives are required for each passenger. There will be required forms for all passengers to fill out within 60 days of acceptance of the offer.

The VISA requirements are for reference material only. We are not responsible for any changes in VISA requirements for entrance into any countries.

RESPONSIBILITY CLAUSE:

Wildlife Vacations, Inc. Incorporated, San Diego, California, its “Internet Sales and Marketing Agents” and the Operator(s) are not your agent and act only as independent contractors and agree to use their best judgment and discretion in regards to advertising and arranging travel, and booking accommodations. You agree to indemnify and hold harmless South America Travel Consultants, Incorporated, San Diego, California, its “Internet Sales and Marketing Agents” and the Operator liability whatsoever for any injury, damage, loss, accident, delay or irregularity which may be occasioned either by reason of defect in any vehicle or through the acts or omissions of any third party or company engaged in conveying or booking the passengers or by virtue of any act or omission of any person or company in carrying out the arrangements of the tour.

Wildlife Vacations, Incorporated, San Diego, California, its “Internet Sales and Marketing Agents” and the Operator(s) accept no responsibility for losses or additional expenses due to delay or changes in air or other services, sickness, weather, strikes, war, quarantine, baggage delay or loss, or other causes. Any losses or expenses will have to be borne by the passengers, as the package price provides arrangements only for the time stated. All prices are based upon current tariffs and current exchange rate. All arrangements are subject to adjustment/change due to operational conditions beyond the control of Wildlife Vacations, Incorporated, San Diego, California, its “Internet Sales & Marketing Agents” and the Operator(s).

CANCELLATION POLICY:

Cancellations received at anytime after the payment is received are subject to forfeiture of 100% of the payment amount. “No-shows” for any reason are subject to a 100% cancellation fee. These conditions are strictly enforced. Once travel has begun, there are no refunds for unused services, meals, or activities for any reason whatsoever.

BAGGAGE:

Baggage and personal belongings are carried at the owner’s risk. We are not responsible for damaged, delayed, or lost baggage for any reason. Please consider the purchase of travel / trip cancellation / baggage insurance to protect your property. Baggage can and does get lost or delayed and the airline coverage in the event of a loss or delay is not comprehensive.

ALTERNATIVE DISPUTE RESOLUTION:

If a dispute arises out of or relates to this Agreement, or the breach thereof, and if the dispute cannot be settled through negotiation, the parties agree first to try in good faith to settle the dispute by mediation in San Diego County California administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration, litigation, or some other dispute resolution procedure. Any controversy or claim arising out of or relating to this Agreement, or the breach thereof, not resolved by mediation, shall proceed to non-binding arbitration in San Diego County California administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. This agreement shall be governed by the laws of the State of California. Any action brought to enforce any provision of this Agreement shall be brought in San Diego County, California in any Court of competent jurisdiction. In the event that dispute arises concerning the enforceability of the terms of this Agreement including, but not limited to, collection actions, the prevailing party shall be awarded reasonable attorneys fees and costs. Any waiver of any terms or conditions of this Agreement shall not operate as a waiver of any other breach of such terms or conditions or any other term or condition, nor shall any failure to enforce any provision hereof operate as a waiver of such provision or of any other provision hereof. This Agreement may not be amended nor shall any waiver, change, modification, consent or discharge be effected except by an instrument in writing executed by or on behalf of the party against whom enforcement of any amendment, waiver, change, modification, consent or discharge is sought.

If any provision of this Agreement shall be held invalid under the laws or any jurisdiction governing its provisions, such section shall be limited consistent with its intent so that it is valid, or if this is not possible, deleted from this Agreement and shall have no impact upon the other terms of this Agreement, which shall survive with all other provisions intact.
